Considering the submissions of the learned counsels and facts and circumstances of the case, I am of the opinion that this is a fit case where the appellant be given the privilege of anticipatory bail. Accordingly, the impugned order dated 04.12.2017 passed by the learned Additional Sessions Judge-I, Hazaribagh in connection with Katkamsandi P.S. Case No.103 of 2017, corresponding to G.R. No.1537 of 2017, being not sustainable in law is set aside and the appellant named above, is directed to surrender before the court below within four weeks from the date of this order. In case of the appellant being arrested or surrendering in the court of learned Judicial Magistrate -1st Class, Hazaribagh within the stipulated time, he will be enlarged on bail on depositing a demand draft of Rs.5,000/- drawn in favour of informant-respondent no.2Deepak Ram and on his furnishing bail bond of Rs.10,000/-(Rupees ten thousand), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Hazaribagh in connection with Katkamsandi P.S. Case No.103 of 2017, corresponding to G.R. No.1537 of 2017 with the condition that he will not indulge in similar type of offence during the pendency of the case.
