23 . Regarding sentence I, find that that the case is of the year 1996 and till now almost 22 years have passed. The main accused i.e appellant no. 1 Prem Mahara has already remained in custody for about one year 22 days and appellants have faced rigors and vigors of trial and the offence had taken place in the background of family dispute as parties are related to each other and are agnates or gotias . Therefore, period already undergone by the appellants is considered as sentence sufficiently served and hence, appellants sentence is restricted to the period already undergone by them. But,as injury was caused to the informant P.W.3 Debu Das so, surviving appellant no.1 Prem Mahara, appellant no. 2 Malesh Mahara and appellant no.3 Raghe Mahara are directed to pay consolidated compensation of Rs. 5,000/- to the injured informant Debu Das within a period of two months from the date of receipt of copy of this judgment, failing which, they shall undergo S.I. for fifteen days. The amount of compensation may be deposited in concerned or successor court below. Appellants will be discharged of their liability of bail bond after payment of the aforesaid compensation.
