This criminal miscellaneous petition has been filed under section 482 Cr.P.C at the instance of the petitioner with a prayer to restore A.B.A. No.3154 of 2017 to its original file.
Learned counsel for the petitioner submits that this Court by a peremptory order dated 30.08.2017 passed in A.B.A. No.3154 of 2017, directed the petitioner to file a supplementary affidavit regarding the criminal antecedent of the petitioner. But he could not comply the same within the stipulated time due to which A.B.A. No.3154 of 2017 was dismissed. Learned counsel for the petitioner further submits that he has filed the supplementary affidavit and unless the A.B.A. No.3154 of 2017 is restored to its original file, he will be highly prevailed.
Learned Addl.P.P. appearing for the State has not raised any serious objection. Considering the aforesaid submission of the learned counsel for the petitioner and the facts and circumstances of the case, the prayer for restoration of A.B.A. No.3154 of 2017 to file is allowed.
List A.B.A. No.3154 of 2017 after two weeks.
