06/09.07.2018 The present contempt application has been filed against the opposite parties for wilful disobedience and non-compliance of the order dated 08.12.2017 passed by this Court in W.P.(C) No. 1227/2017.
A show cause affidavit followed by the supplementary show cause affidavits have been filed by Mr. Pradhan Manjhi, Circle Officer, Bishnugarh, Hazaribagh (O.P.No.4).
Mr. Shamim Akhtar, learned G.A-III, appears on behalf of the opposite parties and submits that vide order dated 08.12.2017, this Court had stayed the operation of the impugned notice dated 22.02.2017 (Annexure-4 to the writ petition). However, the boundary wall of the petitioner was already demolished on 29.11.2017. Though the O.P.No.4 was present before this Court on 08.12.2017, yet under some confusion, he could not explain the actual position to this Court. The said fact has already been stated by the petitioner in the writ petition. Thus, there is no wilful disobedience and non-compliance of the order dated 08.12.2017 passed by this Court in W.P.(C) No. 1227/2017 by the O.P.No.4. Irrespective of the said fact, the O.P.No.4 has tendered unqualified apology for the omissions on his part.
Considering the aforesaid facts and circumstances, this Court does not intend to proceed with the matter any further.
The contempt proceeding against the O.P.No.4 is hereby dropped.
The present contempt application stands disposed of accordingly.
