The petitioner is an accused for the offence punishable under sections 414, 412 and 34 of the Indian Penal Code and under sections 25(1-b)a, 26 and 35 of the Arms Act.
Prayer for bail of this petitioner was earlier rejected on the ground that the petitioner was absconder. The petitioner has renewed his prayer for bail and submits that there is no material against the petitioner and the arms, which were recovered from the house of the petitioner, were recovered in the absence of the petitioner.
Addl. P.P. opposes the prayer for bail but cannot deny the aforesaid facts.
Taking into consideration the aforesaid facts, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Bahuran @ Ram Suresh Sahu is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Gumla, , in connection with S.T. Case No. 73 of 2016, arising out of Gumla P.S. Case No. 55 of 2010, corresponding to G.R. No. 168 of 2010, subject to condition that the petitioner will appear before the trial Court on each and every date fixed in the case during the trial, failing which the bail bond of the petitioner shall stand cancelled and the trial Court shall take all possible steps for his re-arrest and with a further condition that one of the bailers should be his close relative having sufficient landed property within the jurisdiction of the concerned district.
