Heard learned counsel for the parties.

The petitioners are accused for allegedly committing an offence punishable under Sections 302/34 IPC and Section 27 of the Arms Act.

Son of the informant went out of his house but did not return. Informant suspected that other villagers, with whom she had disputes, have committed murder of her son. Son of the informant left his house, stating that he was going to the house of Prabhu Das. Prabhu Das was arrested who confessed his guilt and taken the name of these petitioners.

Counsel for the petitioner submits that there is no material against these petitioners, save and except the confessional statement of Prabhu Das.

Learned A.P.P. opposes the prayer for bail and refers to paragraph no. 89 of the case diary in which one of the witnesses Dular Mandal stated that when he was near the market, he heard sound of firing. Two-three shots were fired. There was stampede after hearing the sound of firing. He also fled away from the place. He had seen these petitioners fleeing away from the said place.

Taking into consideration the submission of the parties and the material which has been collected, I am inclined to allow these applications. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamtara in connection with Narayanpur Police Station Case No. 18 of 2018 (G.R. No. 80 of 2018).
