Petitioner is apprehending his arrest in connection with Govindpur P.S. Case No. 83 of 2017, corresponding to G.R. No. 2670 of 2017 for the offence under sections 392, 395, 412 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is innocent and he has committed no offence as alleged in the F.I.R. It is further stated that no case under the alleged offences is made out against the petitioner.
Learned A.P.P opposed the prayer for anticipatory bail.
From perusal of para 95 and 97 of the case diary it appears that co-accused have made confession that they sold the looted articles to the petitioner in consideration amount of Rs, 1,28,000/- for which Rs, 28,000/- was paid to them and Rs, 1,00,000/was due and the said amount was distributed between them.
Considering the aforesaid facts and circumstances of the case, I am not inclined to the grant anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is hereby rejected.
