Heard learned counsel for the parties.

The petitioner is an accused for allegedly committing an offence punishable under Sections 419/420/467/468/471/120(B) of the IPC and Section 66( C) (D) of the IT Act.

It is alleged that petitioner was the guard of the ATM where the informant went to withdraw money. It is alleged that when the informant did not succeed to withdraw money, he had taken help of the ATM’s guard to withdraw the money and thereafter with the help of this petitioner Rs. 15,000/- was withdrawn. When he went to the bank, he found that huge amount has been withdrawn from his account and only a sum of Rs. 50,000/- is left in his account. It is alleged that it is this petitioner who had committed the crime.

Counsel for the petitioner submits that there is no material against this petitioner. He submit that save and except the fact that money has been withdrawn from the account of the informant and this petitioner had helped the informant to withdraw the money, there is no other material against this petitioner.

Learned A.P.P. opposes the prayer for bail but does not controvert the aforesaid facts.

Taking into consideration the aforesaid fact, I am inclined to allow this application. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Giridih in connection with Nimiaghat Police Station Case No. 55 of 2016 (G.R. No. 1868 of 2016).
