The petitioner is an accused for allegedly committing offence punishable under Sections 419, 420, 413, 467, 468, 471, 120B and 34 of the Indian Penal Code, Section 66(C)(D) of the Information Technology Act, in connection with Gandey, Police Station Case No.90 of 2016, corresponding to G.R. No. 2376 of 2016, pending in the Court of learned Sub Judge-cum- Judicial Magistrate, 1st Class, Giridih.
It is alleged that the petitioner was transferring money electronically by fraudulent means.
Learned counsel for the petitioner submits that there is no evidence against this petitioner of transferring money in any manner. Learned Addl. P.P opposes the prayer for bail and submits that it is one Rohit Mandal who is the brother of the petitioner who has committed the crime. The bank account of said Rohit Mandal suggest that there was transaction of money. He fairly submits that there is no evidence of transaction of money so far as this petitioner is concerned.
Taking into consideration the aforesaid fact, I am inclined to allow this application. Accordingly, the petitioner, namely, Narayan Mandal, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judgecum- Judicial Magistrate, 1st Class, Giridih in connection with Gandey, Police Station Case No.90 of 2016, corresponding to G.R. No. 2376 of 2016.
