04/12.09.2017: Writ petitioner has prayed for removal of illegal encroachment on certain plots in Mouza Basantra Town of District Godda allegedly over a large area of 28 Bigha 19 Katha and odd.
It, however, does not appear that the petitioner has ever invoked the forum under the Bihar Public Land Encroachment Act, 1956 (now Jharkhand) before approaching this Court. Learned counsel for the petitioner, therefore, after some arguments, seeks permission to withdraw this writ petition in order to approach the competent authority under the Act of 1956 in respect of any alleged encroachment.
In that view of the matter, writ petition is dismissed as
withdrawn.
