09/24.11.2017 What was under challenge in the present writ petition under Article 226 of the Constitution of India is an order passed by the learned Additional Judicial Commissioner-IV, Ranchi in Cr.Misc.Case No.29/2013 dated 25th July 2016.
Learned counsel for the C.B.I. has, at the outset, pointed out that the application made under Section 457 of Cr.P.C. for release of the seized articles, gold bonds, etc. in connection with R.C.41(A)/96 is itself misconceived as the main R.C. Case is no longer pending. The petitioner no.1 has been convicted in the said case along with several other accused persons by the judgment dated 2nd February 2012 passed by the court of learned Special Judge, CBI-VII (A.H.D. Scam Case), Ranchi. Petitioner has also preferred an appeal against the said judgment.
Learned counsel for the petitioners however seeks permission to withdraw this writ petition.
Writ petition is accordingly dismissed as withdrawn with liberty to take proper recourse to law.
