CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY
| For the Petitioner | --------- : Mr. Kaushik Sarkhel, Advocate |
|---|---|
| For the State | : Mr. Arun Kr. Pandey, A.P.P. --------- |
02/08.02.2017 Heard Mr. Kaushik Sarkhel, learned counsel for the petitioner
and Mr. Arun Kr. Pandey, learned A.P.P. for the State.
This application is directed against the orders dated 20.08.2002, 04.02.2003, 22.09.2003 and 29.07.2004 passed by the learned Judicial Magistrate 1st Class, Latehar whereby and whereunder coercive steps have been ordered to be taken against the petitioner in connection with Complaint Case No. 94 of 2001.
It has been submitted by the learned counsel for the petitioner that the petitioner was never aware of the institution of the complaint case and recently the petitioner had come to know that coercive steps have been ordered against the petitioner and he has been declared as permanent absconder.
Learned A.P.P. for the State has opposed the prayer made by the petitioner.
It appears that the petitioner has challenged the orders which were passed more than a decade back. The petitioner on account of his non appearance had been declared permanent absconder on 29.07.2004.
In such view of the matter, I am not inclined to entertain this application. However, if the petitioner surrenders before the learned court below the learned court below shall take appropriate step so that the bail application if preferred by the petitioner is disposed of on the same day itself.
This application stands disposed of.
