Per D.N. Patel, J.
1) Learned counsel for the respondents-Mineral Area Development Authority submitted that monthly installment of Rs.50,000/- and in some cases Rs.25,000/- are being paid towards retiral dues to its retired employees. As a matter of fact, the respondents-Mineral Area Development Authority is making payment to the employees and retired employees from its own limited financial resources and hence, sometimes they are paying this monthly installment slightly at a belated stage. Nonetheless, the counsel for the respondents, upon instruction from his client-Mineral Area Development Authority, submitted that they shall continue to make payment of retiral dues in installments to the applicant till the whole amount of retiral dues is paid.
2) On this assurance, there is no willful disobedience by the respondents of the order passed by this Court in the earlier writ petition, for the non-compliance of which, this contempt application has been preferred.
3) Hence, this contempt application is hereby dismissed. Nonetheless, liberty is reserved with the applicant to move this Court in case of any difficulty.
