02/01.09.2017: Heard learned counsel for both the sides.

Learned counsel for the petitioner states that PW-1 Shanaz Khatoon, who made an accusation, had denied or mitigated the role of the petitioner in her deposition made to the Court. Moreover, learned counsel states that other co-accused, who were named in the FIR by the same lady i.e. Shanaz Khatoon, have been granted regular bail by different Benches of this Court in B.A. No. 6761 of 2015, B.A. No. 9244 of 2015 and B.A. No. 1115 of 2016 vide orders dated 09.10.2015, 06.11.2015 and 01.03.2016 respectively and therefore, this petitioner may be granted anticipatory bail.

Learned A.P.P appearing on behalf of the State has opposed the anticipatory bail application .

Having gone through the case records and after hearing the learned counsel for both the sides, I am inclined to grant anticipatory bail to the petitioner and accordingly, petitioner, named above, is directed to surrender in the court below within two weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs.20,000/-( Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned District Judge-II, Giridih in connection with Birni P.S. Case No. 71/2014, corresponding to GR Case No. 1098/2014 (S.T. No. 94/15) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and he will appear on each and every date of hearing in trial before the court-below unless dispensed with by the court-below and he will not harass the informant and his family members.
