8/15.09.2017: Heard both the counsels.
Learned counsel for the petitioner has submitted that the occurrence has taken place on 11.12.2016 and the FIR was lodged on 26.12.2016 and there is no explanation for this delay. Moreover, he has said that charge has been framed. He has further submitted that petitioner has surrendered on 09.05.2016 and he is already in jail for sufficiently long time, so he should be allowed bail.
Learned counsel for the State has opposed the bail application. He has submitted that the reason for the delay in lodging of the FIR is fully explained and the informant was busy in shradh ceremony of his wife that too of burnt body so the informant was in terrible shocks and anguish and he was not in a position to immediately lodge is FIR.
Having heard counsels for both the side; having gone through the records of the case and in the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, his bail application is rejected.
