Counsel for the petitioner has said that this matter arises out of second FIR but basically on the same set of circumstances. He has also said that in the first FIR, no date and time is given as to when those offences were made. He has submitted that thereafter on 29.05.2012 another case has been instituted for similar offences, so there is repetition of allegation and repetition of case. He has said that in the first case, charge has been framed and the case is at the stage of evidence. Petitioner is in custody from 17.06.2016.
Learned counsel for the informant has said that after 29.5.2012, victim was taken back from the court itself and again the torture and demand started and hence this case. He has also said earlier petitioner was absconder, so bail should not be granted to him.
Having heard counsels for both the side; having gone through the records of the case and in the facts and circumstances of the case, I direct the court below to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 20,000/- ( Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribag in connection with Chouparan P.S. Case No. 13 of 2013 ( G.R. No. 256 of 2013).
