The petitioner has been made an accused in connection with Barkattha P.S. Case No. 75 of 2015 registered under Sections 147,148,341,323,307,506 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case that there is no specific allegation of any overt-act against this petitioner save and except that he had come to the place of occurrence with a spade. It is submitted that on similar allegation co-accused persons have been granted bail by this Court in B.A. No. 491 of 2016 with B.A No. 233 of 2016, with B.A. No. 10300 of 2015 and B.A. No. 10244 of 2015.
Learned counsel for the State assisted by Mr. Vijay, learned counsel for the informant has opposed and submitted that this petitioner along with other co-accused had formed an unlawful assembly hence the complicity of the petitioner is made out.
Considering the fact co-accused on similar allegation have been granted bail, the petitioner above named is directed to be enlarge on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Hazaribagh in connection with Barkattha P.S. Case No. 75 of 2015 corresponding to G.R. No. 3010 of 2015.
