11/ 04.01.2016 Heard learned counsel for the petitioner and learned counsel for the State, as also learned counsel for the complainant informant.
The petitioner is apprehending his arrest in connection with Jagarnathpur P.S. Case No. 25 of 2014 corresponding to G.R. No. 372 of 2014, for the alleged offences under Sections 406, 420, 467, 468, 120-B of the Indian Penal Code.
There is direct allegation against the petitioner to have taken huge amount of money from the complainant on the pretext of development of land, but the land was not handed over to the complainant by the petitioner and the money has been misappropriated.
It is submitted by the learned counsel for the petitioner that the petitioner is ready to refund back the money, which he has taken from the complainant.
The amount claimed to have been taken by the petitioner is highly disputed between the parties and there is huge difference between the liability accepted by the petitioner and the liability claimed by the complainant. It is an admitted fact that the petitioner had taken money from the complainant. The record shows that the dispute between the parties was sent for conciliation also, but the same failed.
In the facts of this case, I am not inclined to grant anticipatory bail to petitioner, Abhijit Prasad Singh. Accordingly, his prayer for anticipatory bail is hereby rejected.
