4/5.1.2015 The grievance of the petitioner is that the interest over differential amount of pension from 1.4.1997 to 1.1.2007 and interest over the amount of G.P.F till February 1991 has not been paid in spite of the fact that the petitioner had retired from service w.e.f 29.2.1988. Although the respondents have released the interest over the delayed payment, but the interest has been calculated only up to 31.3.1997 while the amount has been paid subsequent to the said date and as such the petitioner is entitled to get interest over differential amount of pension till the date of release of the amount. The petitioner had made due representations (Annexure-4 series) before the District Superintendent of Education, Giridih, but no decision has yet been taken.

On the other hand, learned counsel for the respondents has submitted that if no decision has been taken by the respondents on the petitioner's representations (Annexure-4 series), the appropriate decision will be taken and communicated to the petitioner.

In that view of the matter, this writ petition is disposed of directing the District Superintendent of Education, Giridih (respondent No.3) to decide the claim of the petitioner made in the representations (Annexure-4 series) and take a decision in accordance with law within a reasonable period preferably within a period of six weeks from the date of receipt / production of a copy of this order.

If the petitioner's claim is found genuine, the admitted amount shall be released in favour of the petitioner.

If the respondents dispute the petitioner's claim, the same shall be communicated to the petitioner by a reasoned order.
