Petitioner has approached this Court for release of post retiral benefits i.e. fixation and payment of pension from 01.04.1999 till date on the basis of recommendation of 5^th pay Commission, payment of gratuity, monetary benefits accruing to difference of scale on the basis of 6^th pay Commission, leave encashment benefit, payment of difference of merger scale with effect from 01.04.1999, dearness allowance, difference of pay scale on account of 5^th pay Commission with effect from 01.01.1996 till 31.03.1999 i.e. date of retirement.

The grievance of the petitioner is that he was appointed as Grade-IV employee w.e.f. 16.09.1954 and retired from service on 31.03.1999.

Learned counsel for the petitioner submitted that the aforesaid monetary benefit has not been released in his favour in spite of the fact that he had retired from service on 31.03.1999. He made several representations to the authorities concerned but no heed is being taken by the respondent authorities.

Writ petition is disposed of at this stage by directing the respondent no. 2 to treat this writ petition as representation and take decision within three weeks from the date of receipt of copy of this order and forward the same to the Secretary, Human Resources Development Department along with copy of decision for taking onward action in this regard, who shall take decision within the period aforesaid.
