Heard learned counsel for the parties.
It reveals that on the basis of information lodged by Assistant Mining Officer, present case has been instituted against owner, driver and cleaner of vehicles registration number of which find mentioned in the F.I.R. The aforesaid vehicles were found carrying sand without permit and paper.
It is submitted that the vehicles were being plied with valid documents and permits against transportation of sand. This case has been instituted with ulterior motive. No previous antecedent is appearing from the F.I.R.
Learned counsel appearing for the State have opposed the prayer for bail and submitted that no document was produced against transportation of sand at the time when the vehicle were seized.
Considering the nature of offence, above named petitioners are directed
to surrender before the Court below within a period of three weeks from today and on such surrender they are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned Sub-Divisional Judicial Magistrate, Pakur in connection with Pakur (M) P.S. Case No.104 of 2015 corresponding to G.R. Case No.258 of 2015 subject to the conditions laid down under Section 438(2) Cr.P.C.
