The petitioner is accused in connection with B.S. City P.S. Case No. 48/11 [G.R. No. 175/11], pending in the Court of Chief Judicial Magistrate, Bokaro. It reveals from the F.I.R. that the petitioner had taken Max Pick-up Van on rent from the informant on certain amount but even after plying vehicle, he did not pay rent to the informant and also not responded to the request made.
At the very outset, learned counsel appearing for the State has submitted that process under Section 82 Cr.P.C. has been issued against the petitioner which is apparent from the report received from the Trial Court.
Considering aforesaid facts, without going into merits of the case, this petition stands dismissed being not maintainable. However, if the petitioner surrenders before the Court below within a period of three weeks from today and pray for regular bail, his surrender – cum – bail application may be considered on its own merit without being prejudiced with this order and the surrender – cum – bail application may be disposed on the date of surrender itself .
