5/05.1.2015 Both these cases arise out of the case and counter case and as such, these are being disposed of together by this common order.

Heard learned counsel for the petitioners and learned counsel for the State as also learned counsel for the informant in both the cases.

The petitioners are apprehending their arrests in connection with Chandwara P.S Case No.62 of 2013 corresponding to G.R No.699 of 2013, and Chandwara P.S Case No. 41 of 2013 corresponding to G.R No. 459 of 2013, for the offence under Sections 323, 376 of the Indian Penal Code.

Though there is allegation against the petitioners in the respective cases, but the impugned order of both the cases show that after investigation, the police had submitted final form in favour of the respective petitioners.

It is also submitted by the learned counsels for both the sides that thereafter, the case has since been compromised between the parties.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners, Laxman Yadav & Ram Prasad Yadav. Accordingly, it is directed that in the event of surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 10,000/(ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Civil Judge (Jr. Division), Koderma / Smt. Divya Mishra, learned Judicial Magistrate, 1^st class, Koderma, or her successor, in connection with Chandwara P.S Case No.62 of 2013 corresponding to G.R No.699 of 2013 / Chandwara P.S Case No. 41 of 2013 corresponding to G.R No. 459 of 2013, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
