The petitioner, by way of filing the present writ petition under Article 226 of the Constitution of India, has prayed for direction upon the respondent authorities to perform their statutory duties and dispose of the case Jamabandi Radh Abhilekh Sankhya 03/09-10, pending since 01.09.2009.

Heard the learned counsel for the petitioner as well as learned counsel appearing on behalf of respondent-State and perused the materials placed on record.

It appears that the above referred case is pending since 01.09.2009 before the L.R.D.C., Dhanbad. It further appears that the L.R.D.C. called for report from the Anchal Adhikari, Nirsa Block, Nirsa in this regard. But it appears that the Anchal Adhikari has not sent/forwarded report to the L.R.D.C. and therefore, the L.R.D.C. has not taken any decision in the matter. It further appears that the petitioner made an application dated 19.3.2013 before the Anchal Adhikari, Nirsa Block, Nirsa, District- Dhanbad requesting therein to submit the report to the L.R.D.C., Dhanbad so that above referred case can be heard and decided expeditiously by the L.R.D.C., Dhanbad.

Learned counsel for the petitioner has also drawn attention of this Court to the fact that in similar situation, this Court has given a direction to the authorities concerned in WPC No. 4991/2005 vide its order dated 01.11.06 for disposal of the case within stipulated period.

In view of the above facts and circumstances of the present case, the L.R.D.C., Dhanbad is directed to deal with and decide Jamabandi Radh Abhilesh Sankhya 03/09-10 after affording reasonable opportunity to the parties expeditiously, preferably, within a period of one months from the date of receipt of a copy of this order. The report from the Anchal Adhikari, Nirsa Block, Nirsa, if required, be called for immediately, if the same is not received so far. Put up this case on 12th August, 2013.

The learned counsel for the State shall produce a copy of the report of Anchal Adhikari, Nirsa Block Nirsa as well as the decision that may be taken by the L.R.D.C., Dhanbad on record on the next date i.e. on 12th September, 2013.
