07/ 12.09.2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Nawadih P.S. Case No. 11 of 2014 corresponding to G.R. No. 92 of 2014, for the alleged offences under Sections 414 / 34 of the Indian Penal Code and Section 32(ii) of the Coal Mines Act.
Several motorcycles were apprehended by the police, on which stolen coal were being transported. One of the motorcycles, on which stolen coal was loaded, belongs to the petitioner.
Learned counsel for the petitioner has submitted that the petitioner
has been falsely implicated in this case and has accordingly, prayed for anticipatory bail.
Learned counsel for the State on the other hand has opposed the prayer.
In the facts of the case, I am not inclined to grant anticipatory bail to
the petitioner, Sarif Mian. Accordingly, the prayer for anticipatory bail is rejected.
