04/ 10.09.2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Forest Case No. 17 of 2011, for the alleged offences under Sections 33, 41 and 42 of the Indian Forest Act.
It is alleged that the accused persons were engaged in illegal mining of stone and were loading the same on a tractor, however they managed to flee away upon seeing the Forest Officials. The tractor loaded with illegally mined stone was seized and illegal mining was found to be done at the place of occurrence. The petitioner is named in the FIR to be one of the persons engaged in the offence and the seized truck also belongs to this petitioner.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has accordingly, prayed for anticipatory bail.
Learned counsel for the State on the other hand has opposed the
prayer.
In the facts of the case, I am not inclined to grant anticipatory bail to the petitioner, Deglal Mahto. Accordingly, the prayer for anticipatory bail is rejected.
