The petitioner is an accused in a case instituted under Sections 302/201/380/34 of the Indian Penal Code
Learned counsel appearing for the petitioner submits that for commission of murder of four persons, a case was registered against Saiyad Rizwan and Chaitali Bhowmik @ Shehnaz @ Sontu, whose complicity in the commission of murder of four persons was found during investigation. They were put on trial also and were also convicted. So far this petitioner is concerned, no evidence is there at all to show the involvement of the petitioner in the commission of offence of murder, rather what has come against this petitioner is that the petitioner helped other accused persons in disposing of the dead bodies but for that the petitioner can be held liable only for the offence under Section 201 of the Indian Penal Code and the act of the petitioner in disposing of the dead bodies has been disclosed by the co-accused Saiyad Rizwan in his confessional statement which does not have any evidentiary value.
In this regard it was further submitted that one other witness has said about that but that witness has also participated in disposing of the dead bodies but it is strange to note that he has not been made accused. Under the circumstances, the petitioner deserves to be admitted on bail.
Regard being had to the facts and circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount
each to the satisfaction of Additional Sessions Judge-1, Jamshedpur in S.T.No.323 of 2012 arising out of Telco (Govindpur) P.S. Case no.103 of 1999 (G.R.No.970 of 1999).
