04/ 14.11.2014 The petitioner is an accused in a case registered under Section 304(B) of the Indian Penal Code in connection with Bengabad P.S. Case No. 04/2012, corresponding to S.T.No.256/2012 (G.R.No.80/2012), pending in the Court of District & Addl. Sessions Judge-III, Giridih.

It reveals from the written report that daughter of the informant, who was married with the petitioner, died in otherwise than under normal circumstances in her matrimonial home. The allegation of demand of dowry is also there.

It is submitted that except informant, remaining witnesses have turned hostile. The case is pending only for viscera report and the petitioner is rotting in jail custody since about three years.

Learned Counsel for the State has opposed the prayer and submitted that prayer for bail made on behalf of this petitioner has already been rejected by this Court on merit on 17.05.2013 vide B.A.No.4252/2013. The status report submitted by the Trial Court indicates that the trial is likely to be concluded within 3-4 months.

In the circumstances, the learned Trial Court is directed to conclude the trial within four months from the date of presentation of this order by taking all possible steps to secure the viscera report.

I do not find any fresh ground to reconsider the prayer for bail made on behalf of this petitioner. Hence, his prayer for bail stands rejected.
