The petitioners are apprehending their arrests in connection with Garhwa P.S. Case No. 410 of 2013 corresponding to G.R. No. 1946 of 2013, for the alleged offences under Sections 341, 323, 325, 307 / 34 of the Indian Penal Code.

There is allegation against the petitioners and the other co-accused persons to have assaulted and injured two sons of the informant.

It is submitted by learned counsel for the petitioners that there is only omnibus allegations against all the accused persons and in the similar circumstance, the other two co-accused persons have already been granted anticipatory bail by order dated 30.4.2014 in A.B.A. No. 4946 of 2013, as it was found that there was no injury on any vital part of the body of the injured.

In the facts of the case, since the other co-accused persons have already been granted anticipatory bail, I am inclined to grant anticipatory bail to the petitioners, Taukid Khan @ Taukir Khan @ Taufir Khan, Maksud Alam Khan and Ibrahim Khan. Accordingly, it is directed that in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Garhwa P.S. Case No. 410 of 2013 corresponding to G.R. No. 1946 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
