Bail application filed by petitioner Subhas Mishra in connection with Adityapur (R.I.T.) P.S. Case No. 191 of 2013, corresponding to G.R. No. 774 of 2013 (S.T. No. 248 of 2013) pending in the court of learned Sessions Judge, at Seraikella, is moved by Sri Ananda Sen, learned counsel for the petitioner and opposed by Sri Shekhar Sinha, learned Additional PP for the State.
From perusal of paragraph Nos. 4 and 5 of the case diary, it appears that petitioner took the deceased at the bank of river and assaulted him and thereafter drown him in the river.
Under the said circumstance, I am not inclined to enlarge petitioner above named on bail. Accordingly, his bail application rejected.
