4/03.9.2014 Heard the learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner is apprehending his arrest in connection with Giridih (M) P.S. Case No.337 of 2012 corresponding to G.R. No.3024 of 2012, for the alleged offences under Sections 307, 326, 341/34 of the Indian Penal Code.
From the FIR, it appears that the brother of the informant, who had gone to attend a meeting, returned back badly injured on a tempo, and he informed that the accused persons, including the petitioner, had assaulted him and there is specific allegation against the other co-accused persons to have fired revolver upon the victim and also to have cut the neck of the victim by bhujali.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and there is no specific allegation against the petitioner.
Learned counsel for the State has opposed the prayer.
In the facts and circumstances of the case, I am not inclined to release the petitioner Mukesh Kumar Verma @ Mukesh Verma on anticipatory bail. Accordingly, prayer for anticipatory bail stands rejected.
