02/08.07.2014 An urgency slip was filed by the counsel for the applicants and therefore, the matter has been listed today.
Heard the learned counsel appearing for the parties and perused the documents on record.
The learned counsel appearing for the applicants submits that the applicants are apprehending their arrest in connection with Barkatha P.S. Case No. 84 of 2013 corresponding to G.R. No. 1307 of 2013 registered under Section 304B/34 of the Indian Penal Code.
The learned counsel appearing for the applicants submits that though the first information report bearing Barkatha P.S. Case No. 84 of 2013 was registered on 14.04.2013 against the applicants and other three persons, in sessions trial being S.T. No. 429 of 2013, the husband and mother-in-law of the victim lady has been acquitted from the charges. It is further submitted that another co-accused namely, Jalil Mian has been granted anticipatory bail vide order dated 12.02.2014 in A.B.A. No. 4110 of 2013.
The learned A.P.P. appearing for the State opposes the prayer for grant of anticipatory bail.
In the facts and circumstances of the case, in the event of arrest of the applicants or if they surrender before the trial court within a period of four weeks from today, the applicants namely, Mansur Alam @ Mansoor Alam and Md.
Nasim would be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Hazaribagh in connection with Barkatha P.S. Case No. 84 of 2013 corresponding to G.R. No. 1307 of 2013.
