The petitioner has been made accused for the offences under Sections 302, 201, 379, 411, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act, in connection with Chirkunda (Gulfarbari) P.S. Case No. 195 of 2009 corresponding to G.R. No. 2849 of 2009, S.T. No. 345 of 2012/16 of 2012.

The case relates to triple murder. The petitioner is not named in the FIR though other accused persons are named.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case, though there are eyewitnesses to the occurrence, but the eyewitnesses have not named the petitioner. It is submitted that the name of the petitioner has come on the basis of suspicion and on the statement of one spy that the petitioner was also there while dead bodies of the deceased were being disposed of. Learned counsel has accordingly prayed for bail.

Learned A.P.P. for the State has opposed the prayer for bail submitting that there is allegation against co-accused to have assaulted the deceased and he has also stated that there is some eyewitnesses also, who have stated that the named co-accused persons and other persons had assaulted the deceased, but it is admitted that the eyewitnesses have not named the petitioner. It has also been pointed out that one spy has informed the police that while the dead bodies were being carried, the petitioner was also there.

In the facts of this case, I am inclined to enlarge the petitioner, Md. Naushad @ Naushad Ansari, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-VI, Spl. F.T.C., Dhanbad, in connection with S.T. No. 345 of 2012/16 of 2012, arising out of Chirkunda (Gulfarbari) P.S. Case No. 195 of 2009 corresponding to G.R. No. 2849 of 2009.
