Learned counsel appearing for the petitioner while referring to page no. 7 of the paper-book has submitted that the petitioner has been made an accused in Koderma P. S. Case No. 76 of 2013 corresponding to G. R. No. 332 of 2013 registered under Sections 379 & 411 of the Indian Penal Code, JMMC Rules 2004, under Section 33 of the Indian Forest Act and VAT Act 2005.
Learned counsel appearing for the petitioner submitted that the petitioner is the driver of the vehicle and he is also the owner of the vehicle. The charge-sheet has been filed and the petitioner has surrendered in the Court on 2.4.2013. The learned counsel appearing for the petitioner further submitted that other coaccused persons namely, Vijay Pandit and Vishwanath Yadav alias Vishwanath Pd. Yadav have also been granting bail by this Hon'ble Court vide order dated 16.05.2013 in B. A. No. 4594 of 2013 and order dated 09.05.2013 in B. A. No. 4190 of 2013 respectively.
Learned counsel appearing for the State has opposed the prayer for grant of bail and submitted that there is allegation of carrying stone chips illegally without challan.
In the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Koderma P. S. Case No. 76 of 2013 corresponding to G. R. No. 332 of 2013.
