Moreover, counsel for the original petitioners have heavily relied upon Annexure 21 to the rejoinder affidavit filed on behalf of the petitioners in W.P (S) No. 426 of 2004 and as per this Annexure 21, government has accepted the liability to make payment of the salary, inclusive of the dearness and other allowances, to the original petitioners. In view of this annexure, it is submitted by the counsel for the original petitioners that no error has been committed by this Court while passing the order dated 5th December, 2008, passed in W.P.(S) No. 426 of 2004.
