02/14.09.2012 Learned counsel for the petitioners has confined his prayer made in this application only for the petitioner No.1, namely, Saiyad Kamrullah and he has not pressed this application for rest three petitioners.

The instant application has been filed for modification of the order dated 16.05.2012 passed in Cr.M.P. No. 831 of 2012 and the order dated 19.07.2011 passed in A.B.A. No. 1948 of 2011 to the extent to exempt the petitioner No.1 for his appearance for three months as he is going for 'Haj”.

Learned counsel for the petitioners has submitted that the petitioner No.1 has already obtained permission for 'Haj' and he is going for 'Haj' on 17.09.2012 and according to the programme, he will return on or by 20.12.2012. To support his contention, he has annexed a copy of the passport as Annexure-2 and receipt of registration fee deposited by him for the said trip as Annexure2/1 in this application.

Learned counsel for the State has no objection as the petitioner No.1 is going for 'Haj'.

Considering the submissions made by both the parties, I modify the aforesaid order to the extent that the petitioner No. 1 is exempted to appear before the trial Court for the period from 15.09.2012 to 31.12.2012 on the date of the trial fixed in the trial Court, but thereafter, from 01.01.2013 the petitioner No.1 will remain present before the trial Court, as directed in the order dated 16.05.2012 passed in Cr.M.P. No. 831 of 2012.

With the aforesaid modification, order dated 16.05.2012 in Cr.M.P. No. 831 of 2012 and order dated 19.07.2011 passed in A.B.A. No. 1948 of 2011 in respect of the petitioner No.1 is modified.

Accordingly, Cr.M.P. No. 1827 of 2012 is disposed of.
