This petition under Article 226 of the Constitution of India is directed against the order dated 28^th October, 2025 passed by the Central Administrative Tribunal, Srinagar [“the Tribunal”] in M.A. No. 1530/2025 in O.A No. 1169/2025 titled “ Namy Jan Vs. Forest Department” , whereby the Tribunal has directed the petitioners herein to consider and release the pending salary of the applicant and to allow the applicant to continue.

The impugned order has been challenged by the petitioners primarily on the ground that the Tribunal has not appreciated the fact that the services of the respondent had been dispensed with w.e.f 28^th February, 2024 and was not in position as on date when the interim order was passed.

Having heard learned counsel for the parties and perused the material on record, we are of the considered opinion that this petition can be disposed of by providing as under:

a. that the petitioners shall consider and release the pending salary of the respondent, if any;

¶20

b. that the petitioners shall maintain status quo with regard to

¶21

the service status of the respondent as it existed on 28^th October, 2025.

¶22

c. that the Tribunal shall make an endeavor to dispose of the matter at the earliest preferably within a period of three months.

d. that the petitioners shall file their objections before the

¶24

Tribunal by or before the next date.

¶25

Ordered accordingly.
