Petitioner through the medium of this petition has prayed for the

following reliefs:

a. Issue a Writ, Order or Direction in the nature of Certiorari, for quashment of impugned eviction notice Ref. No. NRL/Adm/IIG/237, Dated 17-062025 qua vacation of HARL (High Altitude Research Laboratory) Guest House Room No. 07 issued by Officer In-charge Bhabha Atomic Research Centre and

Astrophysical Science Dated 17-06-2025 forming Annexure-l of the Writ Petition.

b. Issue a Writ, Order or Direction in the nature of prohibition, restraining the Respondent BARC to evict the Petitioner from present accommodation and direct them shift and allot the Petitioner quarter as per eligibility and entitlement.

c. Issue a Writ, Order or Direction in the nature of Mandamus, direct IIG Respondent to release the withheld HRA a DoPT orders and guidelines and other benefits including unpaid salary.

d. To direct that your Lordships may be awarded the costs of this Petition.

e. Any other relief which this Hon'ble court deem fit and proper may also be granted in favour of the petitioners and against the respondents.

Mr. T. M. Shamsi, learned DSGI, while appearing for the respondents submits that the petitioner was relieved from Gulmarg, where he was holding the Room No. 07 of the Guest House of the High Altitude Research Laboratory (HARL), in the month of March-2026, upon attaining the age of superannuation w.e.f. 15.02.2026. As such, the petition filed by him has been rendered infructuous and prayed that the petition be disposed of, accordingly.

The learned counsel for the petitioner, however, submits that the relief sought by the petitioner to the extent of part (a) and (b) have been rendered infructuous, in view of his superannuation and having returned to his home in Tamil Nadu, however, the petitioner reserves the right to agitate the relief with regard to withholding of his HRA claims as per the DoPT orders and other

benefits, including unpaid salary. He submits that the petition may be disposed of reserving the right of the petitioner to agitate his grievance as sought in relief part (c).

In view of the submissions made by the learned counsel for both the parties and the fact that petitioner having attained superannuation during the pendency of this petition in the month of March-2026, the petition is, therefore, disposed of at this stage, holding that the reliefs (a) and (b) have been rendered infructuous in view of the superannuation of the petitioner. However, the petitioner shall be at liberty to file fresh petition in case the cause survives with regard to relief (c).
