1. Impugned in this petition filed under Article 226 of the Constitution of India is the judgment dated 27^th May, 2021 passed by the Armed Forces Tribunal, Regional Bench, at Jammu [“the Tribunal”] in O.A. No 289/2020 titled “ Jaswant Singh Vs. Union of India and others”.

Learned counsel appearing for the both the sides are ad idem with regard to the fact that the issue raised in this petition is no longer res-integra and is covered by the judgment of this Court dated 10^th February, 2026 passed in WP(C) No. 1748/2024, titled “ Union of India and others vs. Sham Singh ” as also the

judgment of this Court dated 9^th April, 2026 passed in WP(C) No. 794/2024 titled “ Union of India and others Vs. Lakha Singh”.

Having heard learned counsel for the parties and perused the material on record, we are of the considered opinion that the issue raised in this petition by the Union of India is no longer res-integra and is wholly covered by the law laid down by this Court in the cases of Lakha Singh and Sham Singh supra . We, therefore, find no merit in this petition and the same is accordingly dismissed.

The petitioners are directed to process the case and pass final orders within a period of three months from the date a copy of this order is served upon them.
