The counsel for the appellant tried to persuade this Court that the said allotment of land, which was being processed pursuant to his application as per the policy for the purpose of setting up an industry, has been refused only on the ground that the new policy has now come into vogue.

The counsel tried to impress upon the Court that his case was pending for a long time and, while he had applied for the allotment of 06 marls of land way back in 2015, which was also consequential to the earlier allotment made in November, 2010, then his case of allotment, which has been refused, ought to have been considered under the old policy.

This Court is of the firm opinion that the appellant was unable to show any arbitrariness or any other violation of the statute which could entitle him for consideration under the old policy.

At this stage, learned counsel for the appellant seeks liberty that he may be permitted to pursue his matter for allotment afresh under the new policy.

The impugned judgment does not create any impediment in doing so. Thus, the present appeal is disposed of while giving liberty to the appellant to proceed as per the new industrial policy which is in vogue. The appellant shall, however, be at liberty to place all the previous facts which led him to seek allotment of 14 marlas of land before the respondents, and the same shall be considered and decided by the respondents strictly in accordance with law within a period of three months from the date of submission of a certified copy of this order.
