01. Petitioner through the medium of this petition quashing of the

following:-

a. Process issued against the petitioner by the Court of learned Excise Magistrate, Jammu in case bearing Registration No. 102214/2020 and CNR No. JKJM030023922020 titled “Shriram Tpt Finance Co. Ltd. Vs. Balblr Singh.”

b. Proceedings initiated against the petitioner under Section 138 of Negotiable Instruments Act by the Court of Learned Excise Magistrate, Jammu in case bearing Registration No. 102214/2020 and CNR No.

JKJM030023922020 titled, “Shriram Tpt Finance Co. Ltd. Vs. Balbir Singh.”

c. Such other additional or alternative relief as this Court deems fit and proper in the facts and circumstances of the case of the petitioner may also be passed in favour of the petitioner and against the respondents.”

02. Learned counsel for the parties submit that the parties have settled the matter outside the Court with regard to the complaint titled, “ Shriram Tpt Finance Co. Ltd. Vs. Balbir Singh under Section 138 of the Negotiable Instruments Act, impugned in this petition and pending before the Court of learned Excise Magistrate, Jammu ( for short, “the trial Court ”)”.

Learned counsel for the parties further submit that the matter has been settled for payment of a sum of ₹5,17,875/-, payable by the petitioner herein as an accused, to the respondent herein as complainant, which has already been paid on 30.06.2026. A scanned copy of the Receipt in this regard has been produced by learned Senior counsel for the petitioner, which is taken on record.

04. In view of the amicable settlement made between the parties and the submissions made at the Bar, this petition is allowed and the impugned complaint titled, “ Shriram Tpt Finance Co. Ltd. Vs. Balbir Singh ”, pending before the trial Court alongwith consequential proceedings/orders, is quashed.

05. Petition is, accordingly, disposed of , accordingly, as allowed alongwith connected application(s).
