This petition is fit to be disposed of at its very inception stage without undertaking any adjudication on merits by bearing in perspective the fact that the petitioner has an option of appearing before the Court of learned Additional Special Mobile Magistrate, Doda, in an application filed on 17.02.2026 by the respondent for the purpose of seeking execution of an order dated 24.05.2025 , and to oppose not only the maintainability of said application and its cognizance but also the prayer made therein with respect to execution of the order dated 24.05.2025 .

Non-bailable warrants issued to procure the presence of the petitioner before the court below shall now be deemed to have been withdrawn/cancelled with a direction to the petitioner herein to appear before the Court of learned Additional Special Mobile Magistrate, Doda on next date of hearing i.e., 15.09.2026 , on which

date, upon appearance of the petitioner, he shall be afforded an opportunity not only to answer the application of the respondent on merits but also on the point of maintainability of said application whereupon the learned court below to undertake the requisite adjudicatory exercise.
