1. After arguing for a while, learned counsel for the petitioners, when confronted with the maintainability of the instant petition, whereby the petitioners, through the medium of the present petition, seek quashment of FIR bearing No. 32/2021, dated 24.03.2021, and pursuant thereto, the challan has also been filed vide Challan No. 1237/2024 dated 25.06.2024, which is presently pending before the Court of learned City Judge, Jammu, seeks withdrawal of the instant petition with a liberty to pursue the matter before the learned trial Court, where the challan has been filed and the trial is going on.

2. The writ petition is dismissed as withdrawn, with liberty as prayed for.

3. Before parting, this Court would like to clarify that no decision on the merits of the case has been expressed by this Court. However, the learned trial Court shall proceed in accordance with law, without being influenced by any observation or order passed by this Court. It is expected that the

learned trial Court shall proceed with the matter expeditiously, in

accordance with law.
