In the instant contempt petition, the petitioner herein has alleged noncompliance of judgment/Order dated 09.09.2015, passed by this Court in SWP No. 2521/2015, titled, “R.S. Salathia Vs. State of J&K & Ors”, operative portion of which is reproduced as under:-

“In view of the statement of learned counsel for the petitioner, the writ petition is taken on board and is disposed of by directing respondent No. 3 to consider and decide the claim of the petitioner for being regularized as Executive Engineer (Electrical) w.e.f., 17.07.1996 i.e., the date the petitioner was placed as In-charge Executive Engineer (Electrical) in accordance with the rules and regulations applicable by taking into account the decision of this Court as referred to by the learned counsel for the petitioner, if applicable to the facts of this case.

It is made clear that in case the petitioner is found eligible to the relief claimed in the writ petition, respondent No.3 would pass appropriate orders as expeditiously as possible preferably within a period of eight weeks from the date of

receipt of certified copy of this order along with copy of judgment relied upon by learned counsel for the petitioner. Disposed of in the aforementioned terms.”

Compliance report stands filed wherein it is stated that the claim of the petitioner has been considered and the same has been rejected being devoid of any merit in terms of Government Order No. 184-JK(PDD) of 2026 dated 03.09.2026, wherein it is stated that in terms of J&K Engineering (Gazetted) Service Recruitment Rules notified vide SRO-209 dated 04.09.1992, the petitioner shall become eligible for regularization as superintending Engineer w.e.f. 01.12.2005, however, the petitioner had already retired on superannuation on 30.04.2004, therefore, could not have attained eligibility for regularization as superintending Engineer.

Respondents have complied with the order dated 09.09.2015, in its letter and spirit, by passing a consideration order dated 03.09.2026, which has been placed on record as Annexure-I to the compliance report, as such, the instant contempt proceedings are closed , however, liberty is granted to the petitioner to challenge the consideration order dated 03.09.2026, if so advised.
