1. A writ petition WP(C) No.1914/2024 preferred by three persons namely Amarjit Singh, Ramesh Chander and Sukh Dev Singh came to be disposed of by an order dated 07.05.2025.

2. In the said writ petition, there were five writ respondents.

3. In terms of order dated 07.05.2025, the writ court was convinced that the case of the petitioners was covered by judgment given in WP(C) No.2823/2023 titled “Sanjeev Bhagat and Ors. V/s UT of J&K and Ors.” as well as “Rajinder Abrol and Ors. V/s UT of J&K and Ors.” in WP(C) No.3267/2023 and therefore, on the similar lines attending the outcome of the aforesaid two cases, the writ petition of the present petitioners was disposed of with a direction unto the writ respondents of the time to release the retiral benefits of the petitioners including the CP Fund along with applicable interest within a period of three months from the date of receipt of order dated 07.05.2025.

The petitioners accordingly dispatched copy of order dated 07.05.2025 through registered posts, receipt dated 24.05.2025 and thereafter the three months’ period expired in August ending, 2025 from which date onwards, the non-compliance of the writ Court’s direction came to set in but it has taken petitioners more than almost one year to come forward with the present contempt petition by having addressed a legal notice dated 13.07.2026 against the present contemnors’ sent through the registered posts dated 13.07.2026 and by that reference, three months period has not expired for the contemnors herein to take a call in the matter. Therefore, this contempt petition is premature and is allowed to be withdrawn by the petitioners to be filed afresh upon expiry of three months period with effect from 13.07.2026.
