01. By virtue of an order dated 15.05.2017 , the writ court

came to dispose of a writ petition- SWP No. 2027/2014 preferred by the petitioner.

02. In terms of the writ court direction, upon an exercise to be done by the Deputy Commissioner, Jammu in the matter of constituting of a team and submission of a report by the team, the Director School Education, Jammu i.e., respondent No. 2 in the writ petition was to take a call within two months from the date of receipt of certified copy of the order dated 15.05.2017 meaning thereby the entire course of action, as mandated, was to be done by 15.07.2017 or at the end of July, 2017 .

It has taken the petitioner not months but years to first let go and then come up with present contempt petition instituted on 03.08.2026 as if there was a suspension of life and law in the intervening period for the petitioner to come to revival of her senses and seek proceedings in contempt against the present incumbents who in the year 2017 in no manner were there to carry out the compliance of the directions of this Court.

04. If left to the petitioner, this Court is meant to punish Mr. Naseem Javaid Chowdhary, the present Director School Education, Jammu for the default on the part of his successor-in-office in the month of May, June and July, 2017.

05. The contempt jurisdiction is not meant for fun sake just for the fancy of the petitioner, as such, this contempt petition is held to be not maintainable for which the petitioner seeks withdrawal, which is allowed without prejudice to the right of the petitioner to peruse any remedy in law for the cause of action for which the petitioner had come forward with the present writ petition at first instance.
