01. It has been brought to the notice of this Court by learned counsel for the respondents that this Court vide Order dated 27^th October, 2025, has granted interim bail to the petitioner subject to the following conditions:-

i. That he shall furnish personal bond in the amount of Rs.

1.00 lac (Rupees one lac) with one surety of the like amount to the satisfaction of the trial court;

¶15

ii. That he shall not tamper with the prosecution witnesses/evidence and shall not indulge in any criminal activities;

¶16

iii. That he shall remain present before the trial court on each and every date of hearing unless exempted from personal appearance by the trial court;

¶17

iv. That he shall not leave the territorial limits of the Country without prior permission of the trial court and shall surrender his passport, if any, before the trial court. ”

It is submitted by learned counsel for the respondent that the petitioner has been consistently violating the bail conditions with particular reference to Para-3 , which is evident from the perusal of warrant of arrest issued by the concerned court to produce the petitioner as the he has failed to appear before the said court. Copy of the warrant of arrest issued by the court below i.e. Principal Sessions Judge, Kargil, has been provided to the Court and the same is taken on record.

03. Since the interim bail was conditional subject to fulfillment of conditions mentioned hereinabove, the petitioner has violated the same with impunity. Therefore, this Court is not inclined to extend the interim bail so granted in favour of the petitioner by this Court vide Order dated 25^th October, 2025. Accordingly, the learned trial court is directed to proceed with the matter in accordance with law.
