Parveena Rasool and Anr. Vs Union Territory of J and K (Home)

This is a petition by a couple claiming to have contracted marriage out of their free will and volition. The petition is filed on the apprehension that the respondents 5 to 12, who are opposed to the marriage, may harm their life and liberty.

This petition came up for consideration on 10^th February, 2025, when this Court while issuing notice to the respondents for filing objections, directed the respondents 1 to 4 to provide protection to the petitioners as and when they approach the police authorities so as to ensure that right of petitioners to life and personal liberty is safeguarded.

From the conduct of the petitioners, it seems that the impugned order has been adequately taken benefit by the petitioners and, therefore, they have not even chosen to take steps for service of the respondents 5 to 12.

Be that as it may, having regard to the nature of the controversy involved, this petition is disposed of by directing that in case the petitioners still apprehend any threat to their life and liberty, they shall be free to approach the concerned police station for seeking protection. Needless to say that the police authorities, if approached by the petitioners in this regard, shall take remedial measures as are permissible in law so as to ensure the protection of their life and liberty.
