The petitioner has approached this Court seeking quashment of the impugned orders dated 04.02.2022, 12.12.2022, and 11.07.2023, as also the enquiry proceedings initiated in pursuance thereof. The petitioner has further prayed for a direction restraining the respondents from proceeding with the enquiry initiated in terms of Annexure III to the writ petition.

When the matter was taken up for consideration, learned counsel for the parties, after arguing for some time, jointly submitted that the present petition may be disposed of at this stage by issuing a direction to the respondents to complete the enquiry within a stipulated time period.

In view of the consensus arrived at between the parties, the writ petition is disposed of with the following directions:

(i) The respondents shall conclude the enquiry pending against the petitioner within a period of six months from the date of this order.

(ii) The petitioner shall cooperate with the enquiry proceedings and shall furnish all requisite information and documents as may be required by the Investigating/Enquiry Officer.

Insofar as the petitioner’s prayer regarding revocation of his suspension is concerned, the petitioner is at liberty to submit a representation to the competent authority seeking revocation of his suspension. In the event such a representation is made, the respondents shall consider and decide the same strictly in accordance with the applicable rules, and pass a reasoned order thereon.

The petition stands disposed of accordingly along with all pending applications, if any.
