Sabita Abrol and Others ( Lr of Late Sh.Shiv Dass) Vs Rajat Sharma and Ors.

Learned counsel for respondent No. 1 submits that the respondent No 1 has filed an application seeking restoration of suit and further that respondent No. 1 has not filed any application for grant of interim relief along with the application seeking restoration of the suit. The present revision petition is arising out of order dated 24.11.2011 passed by the Principal District Judge, Jammu, thereby upsetting the order passed by the learned City Judge, Jammu in the suit preferred by the respondent No. 1.

In view of the fact that there is no suit pending as on date, the present petition has been rendered infructuous as such, the present petition is dismissed with a liberty to the petitioners to approach the court afresh in the event, the suit is restored to its original number and interim directions are restored and interim directions are revived by the trial court.

Record of the trial court be sent back, in case the same is received in original.
